As is the case elsewhere in life, we remain friendly and factual, even if things get emotional. We reserve the right to remove insults, personal attacks, or disparaging content related to gender, race, sexual orientation, politics, religion, and culture.
Even content that is harmful to minors, obscene, pornographic as well as misleading or illegal will not be tolerated and will be removed immediately.
PUJA is about the wonderful animal world, so we ask that you do not place content with direct or indirect advertising for third-party products or services on our channels. These will be removed by us.
We respect your privacy. For the personal information you share with us through this site, our privacy policy applies in addition to platform providers' own policies.

TIME OF PARTICIPATION FOR WINNER GAMES.

Participation in online or social media sweepstakes and their implementation are governed by the following provisions.
Inasmuch as this is a Facebook sweepstakes, the following applies: all information within the scope of this sweepstakes is provided exclusively on the part of the organizer and/or the prize sponsor. Facebook Ireland Limited Hanover Reach, 5-7 Hanover Quay, Dublin 2, Ireland, ("Facebook") has no connection whatsoever with this competition and does not sponsor, endorse or organise this competition. Therefore, there are no legal claims against Facebook whatsoever.

§ 1 Sweepstakes.

  1. The participation period of the sweepstakes (hereinafter referred to as the "Promotion Period") can be found directly in the sweepstakes.
  2. If the sweepstakes mechanism differs from the mechanisms described in § 4 paragraph 1 of these terms and conditions, this will be described, including the possibility of participation, directly at the participation window of the sweepstakes. Insofar as participation via Facebook is possible, participation in the sweepstakes shall take place in accordance with the description at the entry window of the sweepstakes.
a) Either by using a Facebook application (hereinafter referred to as "Application") on Facebook: This application connected to Facebook can be installed free of charge in the respective Facebook profile of the Participant. After the participant has activated the "like" button, he can participate in the sweepstakes by answering the sweepstakes question posed;
b) or directly on the Facebook website of the organizer, In such case, the participant can participate in the sweepstakes by under the sweepstakes posting on the Facebook page www.facebook.com/[...] a) answering the sweepstakes question with a comment; b) posting pictures/contributions; c) "liking" the post, etc. Insofar as the participant uploads images, videos or texts as part of a post and/or comment, the participant guarantees the organizer to be the legal owner of the rights required for this.
Determining the time of participation is the logged time. Responses/posts/comments/likes not submitted within the promotion period will not be considered. Neither the Promoter, Facebook nor the Collaboration Partners (as defined below) are responsible for any delays in the submission or transmission of the Response and Participant Data.
3. The prizes of the Sweepstakes are provided by various partners (hereinafter referred to as "Prize Sponsor"), so that the Organizer only offers the prizes on behalf of the Prize Sponsors. The Organizer shall not be obligated to provide any service of its own, unless it is itself the sponsor of the prize in the specific case. Promoter according to § 657 BGB and thus solely responsible for all claims in relation to the prizes offered is otherwise the respective prize sponsor.

§ 2 PARTICIPANTS.

  1. Unless otherwise stated, persons who have reached the age of 18 are eligible to participate in this Sweepstakes. Minors under 18 years of age are excluded from participation. A distribution of prizes to minors, whose participation is expressly excluded, will not take place.
  2. The participation in the competition and the distribution of prizes are limited to participants with a registration address in Germany and Austria.
  3. The participant is solely responsible for the accuracy of the data provided for participation in the competition (including the relevant data in the corresponding Facebook account of the participant). All personal details must correspond to the truth. Otherwise, an exclusion from the sweepstakes according to § 3 (4) may occur.
  4. Each participant may only participate once in the sweepstakes. Multiple participations are excluded. The organizer reserves the right to exclude participants in the event of multiple participation from the sweepstakes in accordance with § 3 paragraph 2.

§ 3 EXCLUSION FROM THE WINNER GAME.

  1. Employees and relatives of Puja GmbH as well as the participating providers and prize sponsors are excluded from participation.
  2. In the event of a violation of these conditions of participation, the organizer reserves the right to exclude persons from the competition and not to distribute prizes or to subsequently disallow and reclaim them.
  3. Persons who use unauthorized aids or otherwise obtain advantages through manipulation are also excluded. If necessary, in these cases, winnings can also be subsequently denied and reclaimed.
  4. It is also excluded who makes untrue statements about his person or participates more than once in the sweepstakes.

§ 4 IMPLEMENTATION AND PROCEDURE OF THE WINNER'S GAME

  1. During the promotion period, participants will be asked a sweepstakes question. All prizes will be featured on the sweepstakes page. The winner(s) will be chosen by lot from all participants at the end of the promotion period. Participation options, participation rules, winner drawings, etc. that deviate from this sweepstakes mechanism will be explained to the participant directly on the participation screen for the sweepstakes. In such a case - unless otherwise described there - only these deviating rules apply.
  2. Winners will be notified in writing after the end of the competition. The processing of the prize transfer will then take place in direct contact between the winner and the prize sponsor in accordance with the following terms and conditions on prize notification and forfeiture of the prize in §§ 4 and 5. Insofar as the competition is organized directly on Facebook, the winners will be notified after the end of the competition via the Facebook profile of the respective winner on the part of the organizer. Alternatively, the winners can also be announced after the end of the competition via the Facebook profile of the organizer. Each winner must then contact the organizer via a private message to the Facebook page of the organizer with their correct name within 4 working days after receipt of the prize notification in their Facebook profile or announcement of the winner in the Facebook profile of the organizer. If a winner does not report within this period, the prize will be forfeited.
  3. The item presented as a prize in the competition is not necessarily identical to the item won. Rather, deviations in terms of model, color or the like may exist. The prize sponsor reserves the right to select an item of average type and quality as the prize.
  4. The non-cash prizes (with the exception of motor vehicles and travel) will be sent by the prize sponsor or a third party commissioned by it by forwarding agent, parcel service or post to the postal address to be specified by the winner. Delivery will be free of charge within the Federal Republic of Germany. Any additional transport costs and customs duties shall be borne by the winner. The place of performance remains the registered office of the prize sponsor, despite the fact that the shipping costs are borne by the winner. In the event that delivery is made by a forwarding agent, the forwarding agent will contact the winner to arrange a delivery date. Delivery will generally be made Monday through Friday between 8:00 am and 6:00 pm. The winner must also provide a substitute address in his immediate vicinity to which the prize can be delivered in his absence. If the shipping company does not meet anyone at either the winner's address or the alternate address, a message will be left. The winner has to bear the cost of a new delivery itself.
  5. If the transmission of the prize is not possible or only under unreasonable circumstances, the winner will receive an equivalent replacement. Likewise, the winner receives an equivalent replacement if the original prize in the presented version is no longer available (model change, seasonal goods, etc.).
  6. A cash payment of the winnings or any prize replacement is not possible in any case.
  7. The claim to the prize or prize replacement can not be assigned in principle.
  8. Complaints relating to the implementation of the sweepstakes must be submitted in writing to the organizer at info@puja.pet within 14 days after the reason becomes known, stating the sweepstakes. Complaints communicated or delayed by telephone will not be processed. Inquiries, complaints and claims relating to the prizes are to be made exclusively to the respective prize sponsor.

§ 5 FORFEITURE OF PRIZE.

Unless otherwise provided in these Terms and Conditions, the winner is required to respond within 4 business days after the notification is sent. Otherwise, the claim to the prize is forfeited. Unless otherwise stipulated in these terms and conditions, a new winner will be drawn by lot in such cases. The claim to the prize is also forfeited if the transmission of the prize cannot take place within four (4) weeks after the first notification of the prize for reasons that lie in the person of the winner.

§ 6 PRIOR TERMINATION OF THE WINNER GAME.

The organizer reserves the right to cancel or terminate the sweepstakes at any time without notice and without giving reasons. The organizer will make use of this possibility in particular if for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/ or software) or for legal reasons a proper execution of the sweepstake cannot be guaranteed. Insofar as such termination is caused by the conduct of a participant, the organizer may demand compensation from this person for the damage incurred.

§ 7 DATA PROTECTION.

  1. Inasmuch as the sweepstakes is not organized directly on Facebook or Instagram, it is essential for participation in the sweepstakes to register for the corresponding sweepstakes in the entry mask of the sweepstakes by providing various data (hereinafter also referred to as "registration data"). In the case of Facebook sweepstakes, participation is possible via the registered Facebook account of the participant.
  2. A claim to registration for the sweepstakes or participation in the sweepstakes does not exist.
  3. The organizer collects, processes, uses and stores the participant's data provided during registration for the duration of the sweepstakes for the purpose of the sweepstakes implementation and processing and transmits them for the aforementioned purpose to the respective prize sponsor or to the agency managing the prize sponsor. Without the express consent of the participant, the registration data will not be used for further purposes by the organizer or third parties.
  4. All personal data of the participants will be processed and used by the organizer in accordance with the statutory provisions. Further information can be found in the privacy policy.

§ 8 WIDERRUF.

The participant is free at any time to effect the deletion of his/her registration data and thus withdraw from participation by revocation at info@puja.pet .

§ 9 LIABILITY

  1. The organizer is released from all obligations with the fulfillment or delivery of the prize, unless an earlier point in time results from these regulations.
  2. Claims due to possible material defects and / or defects in title in the prizes donated by the prize sponsors are to be made exclusively against them.
  3. The organizer is not liable for the insolvency of a prize sponsor and the resulting consequences for the implementation of the competition.
  4. The organizer is liable for damages only if the damage is due to intent or gross negligence. For culpable injury to life, limb or health of a natural person, the organizer is also liable in the case of only simple negligence. In addition, the organizer shall also be liable for the breach of a cardinal obligation due only to simple negligence. Cardinal obligations are those whose fulfillment makes the proper execution of the competition and the achievement of the purpose of the contract possible in the first place and on whose compliance a participant in the competition may regularly rely. The foregoing limitation of liability applies in particular to damages caused by errors, delays or interruptions in the transmission of data, in the event of malfunctions of the technical equipment or the service, incorrect content, loss or deletion of data, viruses or in any other way during the use of the application. Liability under the Product Liability Act remains unaffected.
  5. For travel winnings, the organizer is furthermore not liable for the consequences of a justified change in the travel offer or the justified cancellation of the trip by the tour operator. The possibility of payment of the value of the trip is excluded.

§ 10 OTHER.

  1. The right to take legal action is excluded.
  2. The law of the Federal Republic of Germany is exclusively applicable.
  3. If individual provisions of these terms and conditions are or become invalid, the validity of the remaining terms and conditions shall not be affected.
  4. These terms and conditions may be amended at any time by the organizer without separate notification.
